1. The procedure of accessing to public events, meetings of election commissions and polling stations by mass media representatives.
Unimpeded access granted to the media for public events related to elections of the President of Ukraine is guaranteed by the Article 13, part 4 of the Law of Ukraine "On Elections of the President of Ukraine" as well as to the meetings of election commissions and polling stations on election day and the day of repeat voting - Article 28, part 9 of the aforementioned Law.
Thus, members of the media (not more than two representatives from one media) may be present without permission or invitation of the commission on meetings of the election commission, including when counting votes and revealing the results of voting at a polling station on election day or on the day of repeat voting in the room where the voting takes place. There is no time limit for staying at the polling station.
Media representatives must present their editorial license by the request of commission members for coverage of the electoral process directly at the polling stations. As diplomatic and other official missions and consular offices of Ukraine abroad, as well as military units outside Ukraine are regime objects, where according to Article 20, part 5 of the Law the polling stations are created, journalists should notify responsible member of staff about their attendance in advance.
Taking photos and videos is not allowed only in the voting cabin for a secret ballot as during the filling in of the ballots sheets presence of other persons is prohibited, excluding cases when the voter due to disability is unable to fill in a ballot sheet and is allowed to take help from another voter, except members of the commission, candidates for President of Ukraine, their trustees and official observers.
According to Paragraph 1, part 2 of Article 11 of the Law the electoral process is carried out on the basis of legality and prohibition of unlawful interference with anyone in the process. No one has the right to interfere in the work process of election commissions, including representatives of the media, except if otherwise provided by the Law (Article 28, part 17).
According to Article 28 part 11 of the Law of Ukraine "On Elections of the President of Ukraine" election commission may take a decision on the withdrawal of the right to be present at a meeting of the media representatives, if they unduly hinder its realization.
2. Procedure of receiving information.
For receiving any kind of information, including information regarding the voting, the relevant representative of the election commission, in particularly to the chairman or deputy must be applied directly.
Organizing and conducting interviews with members of election commissions is held individually by mutual agreement, in accordance with the applicable Law.
3. Procedure for accreditation of media representatives at the CEC.
Media representative including members of technical staff must be accredited in the Central Election Commission of Ukraine. Accreditation has already begun and will be open until May 10, 2014.
Permanent accreditation (for the whole period of preparations for the extraordinary presidential elections in Ukraine) is done by sending a letter to the Chairman of the CEC M.V.Ohendovskiy. Such letter must be signed by the head of the media with a request to accredit the media representative to activities which are carried out by the Central Election Commission. A sealed letter should contain the following information: title of the media, first and family name of the media representative, as well as his/her position. In order to provide the unimpeded procedure of bringing equipment to the hall of the CEC press center for the live broadcasting a letter with a list of equipment should be send to the Central Election Commission by May, 16 2014.
